These Terms of Service (“Terms”) govern your access to and use of https://www.plainsightfyi.com and any associated subdomains, pages, forms, digital content, communications, products, and services we provide (collectively, the “Services”).

By accessing or using the Services, you agree to these Terms and our Privacy Policy (collectively, the “Agreement”). If you do not agree, do not use the Services.

Important Notice: These Terms include a binding arbitration provision and class action waiver that affect your legal rights.

You must be at least 13 years old to use the Services. If you are under 18, you must have permission from a parent or legal guardian to use the Services.

4) Educational Content + AI Disclaimer (No Professional Advice)

All materials provided through the Services, including any AI-assisted or AI-generated content, are for educational and informational purposes only. They do not constitute legal, financial, investment, tax, medical, or other professional advice.

AI outputs may be inaccurate, incomplete, outdated, or biased. You assume full responsibility for verifying outputs before relying on them. Use of the Services does not create an attorney-client relationship, fiduciary relationship, or professional advisory relationship.

5) Communications (Email, Phone, and SMS/Text)

By providing your contact information, you agree we may contact you about your account, requests, purchases, scheduling, service updates, and support.

SMS/Text Messaging

6) Intellectual Property

You may not reproduce, redistribute, resell, publicly display, or create derivative works from our content without written permission. You may not use our materials or outputs to train other AI systems or create competing products.

7) Digital Products, Webinars, and Access

Digital content (toolkits, courses, webinars, downloads, replays, or similar materials) is licensed to you for individual use only unless explicitly stated otherwise. Sharing, reselling, or redistributing is prohibited and may result in revocation of access without refund.

8) Third-Party Links & Tools

We may link to or integrate with third-party tools or services. We are not responsible for third-party security, legality, accuracy, or availability. Use of third-party services is at your own risk and subject to their terms.

9) Disclaimer of Warranties

The Services and all content (including AI outputs) are provided “as is” and “as available.” We disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, non-infringement, and accuracy. We do not guarantee uninterrupted or error-free service.

10) Limitation of Liability

To the maximum extent permitted by law:

We are not liable for indirect, incidental, consequential, special, or punitive damages (including lost profits, data, or opportunities).

Our total liability for any claim related to the Services shall not exceed $100 USD.

We specifically disclaim liability for reliance on AI-generated content or outputs.

Some jurisdictions do not allow certain limitations, so these may not fully apply to you.

11) Termination

We may suspend or terminate access to the Services at our discretion, with or without notice, including for violations of these Terms.

12) Governing Law

These Terms are governed by the laws of the State of Wyoming and applicable U.S. federal law.

13) Dispute Resolution, Arbitration, and Class Action Waiver

Good Faith Negotiation: The parties must attempt informal resolution within 30 days of written notice.
Arbitration: If unresolved, disputes shall be settled by binding arbitration under JAMS rules in Cheyenne, Wyoming, before one arbitrator.
Class Action Waiver: You may not pursue disputes on a class or representative basis.
FAA: The Federal Arbitration Act governs arbitration.

14) Modifications

We may revise these Terms at any time by posting updates with a new “Last Updated” date. Continued use constitutes acceptance.
